Commercial service terms for companies that subscribe to or activate Dawamiey workspaces, including billing, service operation, customer data, support, and termination.
The customer is the company or organization that creates, pays for, or controls a Dawamiey workspace.
Subscription access depends on the selected plan, payment confirmation, admin activation, seat limits, and any applicable order form.
Customers retain ownership of customer data and give Dawamiey permission to process it to provide the service.
Payment, tax, renewal, cancellation, and support details may be supplemented by an order form, invoice, or written agreement.
1. Agreement structure
These Terms of Service govern paid, trial, demo, and administrator-activated use of Dawamiey by companies and organizations. They apply together with any order form, invoice, subscription request, data processing terms, security documentation, and written agreement signed by Dawamiey.
If there is a conflict, a signed written agreement or order form controls for the affected customer and subscription.
2. Customer and administrator responsibilities
Customer is responsible for its users, administrators, workspace configuration, policies, data, and compliance obligations.
Customer must ensure it has the right to submit employee, contractor, customer, attendance, location, payment, and business data to Dawamiey.
Customer must configure roles, permissions, departments, teams, and access controls appropriately.
Customer must promptly remove users who should no longer access the workspace.
3. Service access and features
Dawamiey provides business software features that may include attendance, leave, organization management, projects, weekly reports, company hub, newsfeed, chat, calls, archive, workspaces, billing, support, notifications, AI assistant, and administrative dashboards.
Available features depend on product edition, plan, configuration, permissions, mobile app capabilities, and whether the feature is generally available, beta, or restricted.
4. Subscriptions, seats, and activation
Plans may be fixed package, per-user, unlimited, monthly, annual, trial, demo, or otherwise described in the subscription offering.
Dawamiey may require payment confirmation, Stripe webhook confirmation, or administrator approval before activating a workspace.
Seat limits, purchased user limits, top-ups, and active user restrictions may apply according to the selected plan.
Dawamiey may suspend or downgrade access if payment is overdue, a trial expires, or usage exceeds the plan limits.
5. Fees, taxes, coupons, and payment
Customer must pay all fees stated in the applicable order, invoice, payment link, subscription checkout, or administrator-created payment request. Fees are exclusive of taxes unless stated otherwise.
Coupons, old-price displays, discounts, credits, and promotions apply only under the conditions shown at checkout or in the applicable offer. A coupon may be limited by plan, offering, currency, date, minimum amount, redemption cap, or other eligibility rules.
Unless an order form states otherwise, fees are non-refundable once the paid subscription period begins, except where required by law or approved by Dawamiey in writing.
6. Customer data
Customer retains ownership of customer data. Customer authorizes Dawamiey to host, process, transmit, back up, secure, analyze, and display customer data as needed to provide, protect, support, and improve the service.
Dawamiey will not sell customer data. Dawamiey may use aggregated or de-identified data to improve reliability, performance, security, and product functionality.
7. Confidentiality
Each party may receive confidential information from the other. The receiving party must protect confidential information using reasonable care and may use it only to perform obligations or exercise rights under the agreement.
8. Support, maintenance, and changes
Dawamiey may provide support through in-app support tickets, email, admin channels, or other methods. Response times may vary unless a separate support plan or service level agreement applies.
Dawamiey may update, improve, remove, or modify features to maintain security, compliance, performance, or product quality. Material changes will be communicated when appropriate.
9. Security and compliance
Dawamiey maintains safeguards designed to protect the service and customer data. Customer is responsible for configuring its workspace, managing user access, obtaining required consents, and using the service in compliance with employment, privacy, labor, tax, and industry-specific laws that apply to the customer.
10. Termination and data export
Either party may terminate according to the applicable order or written agreement. Dawamiey may suspend or terminate access for non-payment, security risk, unlawful use, material breach, or legal requirement.
After termination, customer should export needed data before access ends. Dawamiey may delete or archive customer data after the retention period or as required by law, backup, security, or accounting practices.
11. Warranty, liability, and indemnity
Except as expressly stated in a written agreement, Dawamiey does not guarantee that the service will be uninterrupted, error-free, or meet every customer requirement. To the maximum extent permitted by law, Dawamiey's liability is limited to the amounts paid by customer for the affected service during the period stated in the applicable agreement or, if no period is stated, the previous three months.
Customer is responsible for claims arising from customer data, unlawful use, workspace configuration, user conduct, or violation of these terms.
